Australian Visa Refused
If your Australian visa application has been refused then contact
our office & we may be able to assist with a new visa application or
an appeal on your visa refusal. Most decisions made in Australia can
be reviewed, as well as a number made overseas (usually where a
sponsor, nominator or close family member is involved). When you are
notified of a decision to refuse your application you will be advised
as to whether you may seek a review of the decision made & the time
you have to do so. Strict time limits apply for lodging appeals with
the Migration Review Tribunal (MRT), Refugee Review Tribunal (RRT) &
the Administrative Appeals Tribunal (AAT). If your Australian visa
appeal application is lodged outside the time limit it may not be

Australian Visa Cancelled
In some circumstances a visa to enter/stay in Australia may be
cancelled. If your visa is cancelled for failure to comply with visa
conditions, you may experience difficulty in obtaining a visa if they
attempt to return to Australia.
When you are notified of a decision to cancel a visa you will also be
advised as to whether you may seek a review of the decision made &
the time you have to do so. Where the decision to cancel a visa is
made by the Minister personally, the person has does not have a right
of appeal. Where a departmental officer cancels the visa & the person
is in Australia they will, in most cases, have a right to have the
decision reviewed by the Administrative Appeals Tribunal (AAT).
Strict time limits apply on appeals to the AAT. Applicants seeking
reviews of decisions must apply to the AAT within nine days of being
notified of the decision. In cases where there is no power for the
AAT to review the merits of a case an applicant may seek judicial
review of the legality of the decision.

Australian Visa Expired
If your temporary visa is due to expire then you will need to make
an application for another Australian visa before your current
Australian visa expires. If you remain in Australia once your
temporary visa expires you will become unlawful & may be liable for
detention & removal from Australia. You should also be aware that by
becoming unlawful your right to apply for or be granted a visa might
be restricted.
As an unlawful non-citizen you are not entitled to Medicare, social
security, education & most other services available to lawful
residents. You also have no right to employment. If you have
overstayed your visa by more than 28 days you are subjected to a
mandatory 'exclusion period'. That means that you will not be
permitted to come back to Australia for a period of up to three
years. If you are detained & removed at government expense you will
be charged these costs. If you have valuables & assets in Australia
these can be confiscated to recover the amount spent for your
detention & removal.
If your visa is due to expire or has expired then it is in your best
interest to contact our office immediately so we can lodge another
visa application for you as soon as possible.
